This page lists the U.S. states where BetFly does not currently offer paid subscriptions to the Service. The list is reviewed regularly and may change without prior notice as legal, regulatory, and judicial developments warrant. The most current version of this page controls.

1. Hard-Restricted States

BetFly does not offer paid subscriptions, picks, or other content to residents of the following states:

  • Washington — Washington RCW 9.46.240 makes knowingly transmitting "gambling information" — which RCW 9.46.0245 defines to include wagers, betting odds, and changes in betting odds — by internet or telecommunications a Class C felony. The statute contains no carve-out for sports predictions, picks, handicapping, or analytics. BetFly has determined that providing the Service to Washington residents creates unacceptable legal risk until further clarification is available.

Subscribers in these states will not be able to complete checkout. If BetFly determines that an existing paid subscriber has relocated to a Hard-Restricted State, that subscription will be terminated and any prorated unused portion of the subscription period refunded.

2. States Under Active Review

The following states have ongoing litigation, regulatory inquiries, or licensing regimes that may affect BetFly's ability to operate. BetFly may impose additional restrictions, registration requirements, modified content, or full geofencing in these states at any time without prior notice:

  • Nevada — Active Kalshi-related litigation; information-service licensing regime under NRS 463.01642 / 463.160 under review.
  • New Jersey — Post-Third Circuit ruling regulatory posture under review.
  • New York — Active prediction-market litigation.
  • Utah — Active prediction-market litigation.
  • New Mexico — Active federal litigation.
  • Minnesota — Active Kalshi-related litigation.
  • Tennessee — Tennessee has previously ordered prediction-market exchanges to cease operations; downstream impact on subscription analysis services is under review.
  • Massachusetts — Historical tout-licensing concerns under review.

BetFly will publish material changes affecting these states on this page and notify active paid subscribers in affected states via email prior to any service change.

3. State-Specific Subscriber Requirements

The following states impose additional consumer-protection requirements that BetFly applies in addition to its standard Terms of Service:

  • California — California's Automatic Renewal Law (Business and Professions Code § 17600 et seq.) requires additional disclosure of automatic-renewal terms, an explicit consent step prior to charging, and an accessible cancellation mechanism. California subscribers receive an additional renewal notice prior to each renewal and may cancel at any time via the mechanism described in our Terms of Service.

4. Sportsbook and Prediction Market Availability

Separately from BetFly's own availability, sports betting, prediction markets, and daily fantasy sports are regulated and restricted on a state-by-state basis. BetFly may publish picks for markets that are available on platforms (e.g., FanDuel, DraftKings, Kalshi) that operate in some states but not others.

BetFly does not guarantee that any platform we reference is available, legal, or accessible in your state. You are solely responsible for verifying:

  • That the sportsbook, exchange, or fantasy operator you intend to use is legally available in your jurisdiction;
  • That you meet the applicable age and residency requirements in your state (which may differ from BetFly's baseline 21+ eligibility);
  • That any wagering or trading activity you engage in is lawful where you reside at the time of the activity.

Receiving BetFly content does not authorize you to engage in any activity that is illegal where you reside.

5. International Subscribers

BetFly currently offers the Service only to residents of the United States. Subscribers outside the United States — including subscribers in Canada, the United Kingdom, the European Union, and other jurisdictions — should not subscribe to the Service. BetFly does not target, market to, or knowingly accept subscriptions from non-U.S. residents.

6. Verifying Your Eligibility

BetFly relies on a combination of self-attestation, payment-method billing address, and IP-based geolocation to determine subscriber eligibility. Subscribers are responsible for accurately representing their state of residence at the time of subscription and at all times thereafter. Use of a virtual private network (VPN), proxy, or other circumvention technique to access the Service from a Hard-Restricted state or a non-U.S. country is a violation of our Terms of Service.

7. Updates to This Page

BetFly may update this Restricted States page at any time. Active paid subscribers affected by a material change will be notified by email. The version and effective date at the top of this page identify the current version.
