0. Defined Terms

For purposes of this Disclaimer, the words "pick" and "edge" refer interchangeably to output of BetFly's proprietary statistical simulation. BetFly publishes simulation output as research; nothing in this Service is a recommendation, instruction, or advice to bet.

1. For Entertainment and Educational Purposes Only

All BetFly content — including simulation output (picks, edges, model probabilities), analysis, commentary, charts, Discord posts, and email digests — is provided for entertainment and educational purposes only. Nothing in the Service constitutes financial, investment, gambling, wagering, legal, accounting, or tax advice.

BETFLY IS NOT AND SHOULD NOT BE CONSIDERED A SPORTSBOOK, PREDICTION MARKET, OR WAGERING OPERATOR. BETFLY DOES NOT FUNCTION AS THE COUNTER-PARTY TO ANY WAGER, DOES NOT SET LINES OR ODDS, DOES NOT ESCROW SUBSCRIBER FUNDS, AND DOES NOT PAY OUT SUBSCRIBERS FOR SUCCESSFUL WAGERS.

YOU UNDERSTAND THAT THE SERVICE CONTAINS INFORMATION ABOUT SPORTS, HISTORICAL SPORTS TRENDS, AND SPORTS BETTING, BUT THAT THIS INFORMATION DOES NOT CONSTITUTE "ADVICE," NOR DOES IT CONSTITUTE ANY "RECOMMENDATION" ON WHETHER OR HOW TO ENGAGE IN SPORTS BETTING, PREDICTION-MARKET TRADING, DAILY FANTASY SPORTS, OR ANY OTHER FINANCIAL ACTIVITY.

2. No Guarantee of Outcomes

Past performance does not guarantee future results. Probabilistic edges are estimates derived from statistical models, and all such models are imperfect. Losing days, losing weeks, and extended cold streaks are part of any edge-based strategy. We make no representations or warranties about the accuracy, completeness, or reliability of any pick, model output, or analysis.

We do not guarantee any specific result, return, profit, win rate, or outcome from following our content.

3. Subscriber Decisions Are Your Own

You are solely responsible for any sportsbook, prediction market, daily fantasy sports, or other financial decisions you make. BetFly does not place bets, wagers, or trades on subscriber behalf, does not have access to subscriber sportsbook or prediction market accounts, and does not act as a fiduciary to any subscriber.

You should consult a qualified financial advisor before treating any Service content as part of a financial strategy.

3a. BetFly's Own Trading Positions

BetFly operates an automated trading system that takes positions on Kalshi prediction markets for our own account, based on the same statistical model that produces subscriber picks. In nearly all cases, BetFly's automated trader will execute its own trades on Kalshi before a corresponding pick is published to subscribers via web app, email, or Discord.

Subscribers should understand that as a result:

• BetFly may receive a better entry price than subscribers can obtain when they later act on the published pick.
• On illiquid Kalshi markets, BetFly's positions may already have influenced the price you see at the time of publication.
• BetFly does not coordinate exit timing with subscribers. BetFly typically holds positions through settlement and does not sell into subscriber buying pressure.
• BetFly does not trade on or possess material non-public information obtained from any third party. All picks are produced from the same publicly available data and BetFly's own proprietary model.

By subscribing, you acknowledge this timing structure and agree that BetFly's prior or simultaneous trading does not constitute front-running, manipulation, or breach of any duty.

4. Risk Warning

Sports betting, prediction markets, and daily fantasy sports involve substantial risk of loss. Only stake amounts you can afford to lose entirely. Do not use money required for essential expenses, savings, debt repayment, or other financial obligations.

5. Eligibility, Age, and State Restrictions

You must be at least 21 years old and located in a United States jurisdiction where receiving sports betting information and engaging in the underlying activity is lawful.

We currently do not offer the Service to residents of the following states:

• Florida
• Any state where BetFly determines, in its sole discretion, that providing the Service would create unacceptable legal risk; current excluded states are listed at /legal/restricted-states and may change without notice.

Note: Kalshi event contracts are CFTC-regulated and have an 18+ federal age threshold; state-licensed sportsbooks generally require 21+. BetFly applies the more conservative 21+ requirement to all subscribers, regardless of which platform they use to act on our picks.

Sports betting, prediction markets, and daily fantasy sports are regulated and restricted in many states. You are solely responsible for verifying the legality of any sports betting, prediction market, or DFS activity in your state or jurisdiction. Receiving BetFly content does not authorize you to engage in any activity that is illegal where you reside.

6. Probabilistic Models Are Imperfect

Our edges and probabilities are produced by statistical models that consume publicly available data (box scores, weather, market prices, player statistics). Models may be:

• Miscalibrated for specific players, teams, or market types;
• Sensitive to data quality and feed timeliness;
• Affected by injuries, lineup changes, or events not reflected in the input data;
• Subject to revision as we learn from outcomes.

We continuously refine our models, but no model is ever "done" and none predicts the future with certainty.

6a. How We Document Our Performance

When BetFly publishes performance information (win rates, return on risked stake, profit and loss, cumulative results, or similar metrics):

• The source is Kalshi settlement records for trades BetFly placed in its own account. Each individual trade is time-stamped and graded by Kalshi at market settlement.
• BetFly's performance is not independently audited or attested to by any third party. When we describe our performance as "documented," "tracked," or "Kalshi-settled," we mean it is derived from Kalshi's own settlement data and BetFly's internal trade logs — not that an independent auditor has reviewed or certified the figures.
• Subscriber individual results will differ — sometimes materially — from BetFly's own trading results. Differences may arise from entry-price timing, position sizing, platform availability, market liquidity, individual judgment about which picks to act on, and the inherent variance of edge-based betting.
• BetFly publishes both winning and losing periods. Cherry-picking favorable windows would be inconsistent with our voice charter and this Disclaimer.

6b. Hypothetical or Simulated Results

If BetFly ever publishes hypothetical, simulated, or back-tested performance results (rather than actual settled trading), the following disclaimer applies and will be displayed in immediate proximity to those results in compliance with 17 CFR 4.41(b)(1)(i):

These results are based on simulated or hypothetical performance results that have certain inherent limitations. Unlike the results shown in an actual performance record, these results do not represent actual trading. Also, because these trades have not actually been executed, these results may have under-or over-compensated for the impact, if any, of certain market factors, such as lack of liquidity. Simulated or hypothetical trading programs in general are also subject to the fact that they are designed with the benefit of hindsight. No representation is being made that any account will or is likely to achieve profits or losses similar to these being shown.

7. Independence and Regulatory Status

BetFly is independently operated by DropFly Inc. We are not affiliated with, sponsored by, or endorsed by any sportsbook, prediction market exchange, daily fantasy sports operator, sports league, team, or player. Mentions of specific operators (e.g., FanDuel, DraftKings, Kalshi) are for reference and informational purposes only and do not imply any endorsement, partnership, or recommendation.

BetFly is not registered with the U.S. Commodity Futures Trading Commission (CFTC) as a Commodity Trading Advisor. BetFly publishes standardized one-to-many analysis and picks rather than personalized trading advice tailored to individual subscribers' positions or characteristics, and we believe our publication model qualifies for the registration exemption set forth in 17 CFR 4.14(a)(9). BetFly nonetheless complies with CFTC anti-fraud rules applicable to published trading advice (including 17 CFR 4.41).

BetFly is not registered as an investment adviser under the Investment Advisers Act of 1940 because we do not provide securities advice. CFTC-regulated event contracts traded on Kalshi are not securities.

7a. Testimonials, Endorsements, and Affiliate Disclosures

Testimonials. When BetFly publishes any subscriber testimonial, endorsement, success story, screenshot, or comment describing experience with the Service:

• The depicted experience is not representative of what most subscribers will achieve. Individual subscriber results vary substantially.
• BetFly will disclose any material connection between BetFly and the person providing the testimonial (including free or discounted subscriptions, early access, paid testimonials, or any other consideration).
• For documented engine-wide performance over time, see our public track record page rather than individual testimonials.

Affiliate links. If BetFly ever links to a third-party sportsbook, exchange, or service in a manner that pays BetFly a commission, referral fee, or other compensation, that link will be marked as a "paid link" or "affiliate link" immediately adjacent to the link itself — not buried in a footer or elsewhere — in compliance with FTC Endorsement Guides at 16 CFR Part 255. The presence or absence of an affiliate relationship does not affect which picks BetFly publishes or how we rank sportsbooks for any given pick.

8. Limitation of Liability

DropFly Inc., its officers, employees, and agents are not liable for any losses, damages, or outcomes, financial or otherwise, arising from your use of the Service or any decisions you make based on Service content. See our Terms of Service for the full limitation of liability.

9. Updates to This Disclaimer

BetFly may update this Disclaimer at any time. Material changes will be communicated to active subscribers via email and a prominent notice on the Service. Continued use of the Service after a material update constitutes acceptance of the updated Disclaimer.
